With reference to legal cost, despite the Plaintiffs failing to prove the amount of damages claimed, this Court in exercise of its discretionary powers is incline to award cost in the Plaintiffs’ favour. I do so take into account the long-protracted proceedings that the Plaintiffs had to go through before the present case concluded by way of the assessment exercise before me. Compared to the 4th Defendant which is a money-making corporation, almost all of the Plaintiffs are self-employed. I take the view that they should not be penalize for their failure to prove damages due to their failure to produce income tax documents and bank documents in support of their claim. Under these circumstances, I take the view that a sum of RM10,000-00 to the Plaintiffs (subject to allocator) is reasonable towards costs of proceedings and order so accordingly.
