Information, not legal advice

MY Case Law publishes general information about Malaysian law and what its courts have decided. It is not legal advice and is no substitute for advice from a qualified advocate and solicitor about a particular matter. Everything here describes what courts have already decided in cases they have published. Nothing here is a view about anybody's own circumstances, and no page on this site takes any reader's facts into account.

No advocate–client relationship

Reading this site, or writing to us, does not create an advocate–client relationship. MY Case Law is not a law firm, is not anybody's advocate and solicitor, and does not practise law.

Where the judgments come from

The judgments behind this site are the work of the Malaysian courts, published by the Malaysian Judiciary (Kehakiman Malaysia) through eJudgment, its official judgment portal. We claim no rights over any judgment. Every case page on this site attributes its judgment to that source and links back to it, and the version published there — not our copy of it, and not anything we have written about it — is the authoritative one.

We have not characterised eJudgment's own terms for republication, and this page asserts no licence over material sourced from it. What we can state is our practice: we attribute, we link back, we keep no page that the operator of the source tells us misrepresents its material, and requests about how material from that source appears here go through our corrections and data-removal channel like any other.

The limits of this database

This matters more than a general accuracy warning, so it is set out specifically. An absence from this site is not evidence of an absence from Malaysian law.

• Coverage starts in September 2014. The earliest judgment in our corpus was decided on 11 September 2014. There is no earlier material here at all — not thinly, not partially. A great deal of Malaysian law, including much of what is still authoritative, was decided before that date and is simply outside this database.
• Three courts only. We hold written judgments of the Federal Court, the Court of Appeal and the High Court. Decisions of the Sessions Courts, the Magistrates' Courts, the Syariah courts and the various tribunals are not in this database, and neither are decisions that were never reduced to a published written judgment — which is most of what those courts decide.
• Not every record carries the judgment text. For a substantial share of the cases we hold, we have the case's identifying details and metadata but not the full written judgment. Those pages report what we have, and they say so; they are not summaries of a judgment we have read.
• There is no citator here, and no "cited by". See below — this one is worth its own paragraph.
• Practice areas are derived, and incomplete. A case's practice areas are inferred from the catchwords published with the judgment. Catchwords are written by people, in two languages, in no fixed format, and many judgments carry none that we can classify. So a case missing from a practice area is not a case that is unrelated to it, and a practice-area page is a useful entry point rather than a complete list of everything decided in that field.
• Judgment text is reproduced as published. Text carried over from the source system can arrive with that system's own formatting and stamping artefacts. Where our copy and the published judgment differ in presentation, the published judgment governs.

This site is not a citator

MY Case Law does not tell anyone whether a decision has been followed, distinguished, doubted, overruled or appealed. It offers no "cited by" list, no treatment flags, and no citation history, and no page here should be read as implying that a case is still good law.

The reason is structural rather than temporary. Our case records are keyed to the court case numbers used by the source portal, while the citations appearing inside judgments are law-report references in an entirely different naming system. The two cannot be matched reliably, and a large majority of the cases cited inside our judgments were decided before September 2014 and are therefore absent from the corpus anyway. Building a citation graph on that basis would produce something that looked authoritative and was not, and a citator that is wrong about whether a case still stands is worse than no citator. Verifying the current standing of a decision is work for a practising advocate and solicitor with access to a proper citation service.

Accuracy, currency and availability

We compile from primary sources on a best-effort basis and provide the site as it is, without warranty that it is complete, current, error-free or continuously available. Cases are appealed and overruled and legislation is amended after a page has been written, and pages are not rewritten the moment that happens. Our methodology sets out how content here is produced and where it is generated with AI assistance; the corrections and data-removal policy is how errors get fixed, and we would rather hear about one than not.

Jurisdiction

The content of this site concerns Malaysian law and the decisions of Malaysian courts. It has no application to other jurisdictions, and judgments of courts elsewhere in the Commonwealth appear here only where a Malaysian court discussed them.

Not affiliated with the courts

MY Case Law is an independent project. It is not affiliated with, endorsed by, or operated by the Malaysian Judiciary (Kehakiman Malaysia), and it is not an official record of any court. Where this site and the official record differ, the official record is correct.

People named in judgments

This site builds no pages about private individuals named as parties, at any case count and at any stage of its rollout. Our privacy policy sets out that commitment in full, together with how to ask us to correct or remove something.
