Assessment of damages. Damages assessed for negligence and breach of duty by the defendant causing damage to the plaintiff’s 132kV underground cable. The plaintiff was awarded RM7,650,621.11 for replacement costs and RM1,912,655.28 as general damages for administrative burdens and operational disruptions. The Court accepted the plaintiff’s claim for full indemnity against the third and fourth parties. It held that damages could not be limited to the physically damaged section of the cable affirming the principle of fair compensation.
