This is the Plaintiff’s Notice of Application (Enclosure 10) for summary judgment under Order 14 rules 1 and 3 of the Rules of Court 2012 against both the Defendants jointly and severally. Order 14 empowers the Court to enter summary judgment where the defendant has no defence to the claim or has no defence except as to quantum, unless the defendant satisfies the Court that there is an issue or question in dispute which ought to be tried or some other reason for trial. The Plaintiff submits that the Defendants are indebted for the outstanding settlement sum and late payment interest; that the Side Letter and Letter of Undertaking bind the Defendants; that the Defendants have admitted liability by conduct and correspondence; and that no bona fide triable issue arises. The Defendants resist the application on the grounds that this is within Zurich exclusive jurisdiction due to the Swiss law clause; that the settlement sum is misconstrued; that correspondence is “without prejudice” and inadmissible; that the 2nd Defendant’s liability is limited to “balance payment” and/or is discharged under section 86 of the Contracts Act 1950; and that the late-payment interest computation is said to be questionable. The Court found that the Plaintiff has established a clear and liquidated claim supported by documentary evidence and that the Defendants failed to raise any triable issues.
