1. The circumstances giving rise to this dispute are, in truth, most unfortunate. 2. Although the present claim is directed against the Defendant, the genesis of the conflict lies in the prior dealings and informal arrangements between the Plaintiff and the Defendant’s husband, Edgar, who is also the Plaintiff’s stepfather. 3. The evidence indicates that the Plaintiff had agreed to financially assist Edgar, and that these arrangements became intertwined with the property that is the subject matter of this suit. 4. The property originally belonged to the Defendant, but was thereafter transferred into the Plaintiff’s name. As a result, the Defendant, though not the main actor in the underlying dealings, now finds herself caught in the middle of the disagreement between her husband and his stepson, the Plaintiff. 5. As is often the case when family members transact informally, relying on trust, goodwill, and unrecorded understandings, misunderstandings predictably arose, eventually culminating in this litigation. 6. This Court is faced with two conflicting accounts. Its duty is to evaluate the evidence and determine, on a balance of probabilities, the true nature of the parties’ arrangement and the legal consequences that follow.
