This was an application filed by the Plaintiff (father) primarily for custody and control of the Plaintiff and Defendant’s child. Apart from the prayer for custody and control the Plaintiff is also seeking for disclosure of the Child’s address and school. The Plaintiff and the Defendant registered their marriage on 28.1.2020. This is the second marriage for the Defendant. She has a daughter from her previous marriage. It is my decision that the Defendant shall be given custody care and control of the Child as it is in the Child’s interest and welfare to do so. The Plaintiff has not included alternative prayers for access to the Child if his application does not resonate with the decision of the Court. Be that as it may I am of the view that the Plaintiff should not be denied access to the Child. It is the Child’s right to have a meaningful relationship with both parents regardless of their matrimonial conflict.
