O18 – Plaintiff OS is to nullify a High Court order – no appeal – Application to strike out was allowed - I understand the Plaintiff's predicament and dissatisfaction with the HC order dated 27.4.2018, specifically on paragraph c, which puts the Plaintiff in an awkward position. The land was transferred back to the Plaintiff due to a fraudulent transaction, but the charge was declared valid - I am of the opinion that the prayers in the OS were to declare and set aside an order of a High Court which are coordinate jurisdiction with this Court. It is settled law that a High Court cannot set aside a final order regularly obtained from another High Court of concurrent jurisdiction - the proper recourse would be that the Plaintiff should have appealed on that particular portion of the order to the Court of Appeal, then.
