The Plaintiffs appealed against the dismissal of their Originating Summons. The dispute concerns a family property in Shah Alam built by their late father and still occupied by some family members including the defendants. Following his death, the Plaintiffs became registered proprietors. A Settlement Agreement dated 23 June 2024 gave the Defendants the first right to purchase the property if it was sold. Although the Defendants agreed to purchase, the parties disagreed on price despite three valuation reports. Relying on a joint valuation of RM1,250,000, the Plaintiffs sought to compel the Defendants to buy the property. The court held the valuation was disputed due to alleged illegal structures, no clear enforceable right was shown, and the matter was unsuitable for Originating Summons action.
