[1] This was a divorce petition filed by the Petitioner Wife (PW) to inter alia dissolve the marriage between her and the Respondent Husband (RH), maintenance for herself and the child of the marriage as well as for an equal division of matrimonial property. [2] The RH in his reply did not contest the relief for dissolution of the marriage but strongly disputed all the other claims sought by the PW. [3] After carefully considering all evidence, cause papers and the respective written and oral clarification, I was satisfied and made the following orders: (i) Decree Nisi is granted to be made absolute in 3 months; (ii) Order of Court dated 14.2.2022 is maintained wherein custody care and control of the Child is given to the PW with reasonable access given to the RH; (iii) Child Maintenance is reduced to RM1000 per month to take effect from date of Order and shall continue until the Child’s completion of higher education or training. There shall not be an annual percentage of increase of the maintenance sum. The RH shall not deduct this amount with any miscellaneous payments such as for tuition, education etc.; (iv) PW and RH to bear equally the costs of education of the Child until he attains 18 years of age or completes his higher education or training whichever is the later; (v) 1st Property: the PW is entitled to 50% of the proceeds of the sale of the said property which amounts to RM210,000.00. This amount is to be paid in 3 months from date of this Order; (vi) 2nd Matrimonial Property : The PW is entitled to 50% of the value of the matrimonial home minus the redemption sum due to the Chargee Bank; (vii) PW is entitled to 20% of the RH’s EPF savings and the EPF Board is to give effect to this order; (viii) Parties to bear their own costs.
