In this case the first accused who was initially charged under section 39B of the Dangerous Drugs Act 1952 pleaded guilty on 20 February 2024 to amended charges of possession of drugs under section 12(2) read together with section 39A(2) of the Dangerous Drugs Act 1952 and section 6 read with section 39A(2) of the Act. The second accused claimed trial to both the charges. Later the prosecution on 13 June 2024 withdrew the charges against the second accused. As for the third accused, the prosecution had earlier on 13 January 2023 withdrawn the charges against him. The first accused obtained leave to appeal out of time from the Court of Appeal on 17 September 2025. Therefore this judgment is only as regards the first accused.
