This is an appeal brought by the Public Prosecutor against the decision of the Sessions Court. At the conclusion of the defence, the Sessions Court acquitted and discharged the respondent. The Sessions Court found that the prosecution had failed to prove its case against the respondent beyond reasonable doubt. Having perused the record of appeal and given careful consideration to the submissions of both the learned DPP and the learned counsel, this Court found no appealable error in the findings made by the Sessions Court. The appeal was accordingly dismissed. The reasons are set out below.
