This is an appeal by the Public Prosecutor against the acquittal and discharge of the respondent. The respondent was charged under section 14(a) of the Sexual Offences Against Children Act 2017 (“Act 792”) for allegedly touching an 11-year-old victim for sexual purposes. At the close of the prosecution’s case, the learned trial judge found a prima facie case established and called upon the respondent to enter his defence. Following the defence case, the learned trial judge found that the defence had successfully raised a reasonable doubt in the prosecution’s case and accordingly acquitted and discharged the respondent. Being dissatisfied with the acquittal, the Public Prosecutor appealed to this Court. The appeal was dismissed and the order of acquittal and discharge made by the learned Sessions Court Judge was affirmed.
