Saya mendapati Plaintif telah membuktikan versinya tentang bagaimana kemalangan ini berlaku. Manakala tiada versi Defendan kerana Defendan Pertama tidak hadir untuk memberi keterangan untuk menyangkal versi Plaintif. Keadaan ini menyebabkan versi Plaintif adalah lebih probable dan atas imbangan kebarangkalian ianya memihak kepada Plaintif. Ini ditambah pula dengan keterangan SP2 yang melihat kejadian kemalangan tersebut. Dalam kes Mohd Nor Afandi bin Mohamed Junus v. Rahman Shah Alang Ibrahim & Anor [2008] 3 MLJ 81 Mahkamah Rayuan telah menyatakan: “It must be understood that once a defendant elects not to call for evidence, apart from him being bound by that election, the effect is also that all the evidence led by the plaintiff must be assumed to be true. This proposition of law was succinctly said in Jaafar bin Shaari & Anor (suing as administrators of the estate of Shofiah bte Ahmad, deceased) v. Tan Lip Eng & Anor [1997] 3 MLJ 693 at p 712 : For, once a defendant in civil proceedings elects not to call evidence, then all the evidence led by the plaintiff must be assumed to be true. [22] Dalam kes Formis Resources Bhd & Ors v. Risk Management and Safety System Pty Ltd & Ors and other appeals [2016] 6 MLJ 73 di mana Mahkamah Rayuan telah memutuskan seperti berikut: [31] Where the defendant does not lead evidence to prove its defence or discharge the onus of proof which may have shifted to the defendant, then all that was available for the court to examine in order to determine the claim would be the plaintiff's version of the facts. It is in that context and sense that the case authorities frequently refer to the evidence adduced by the plaintiff as assumed true, correct or accurate. This makes sense as the court does not have any other version or evidence for comparison or evaluation.
