This is an appeal by the Appellant, who was the First Defendant in the court below, against the decision of the learned Magistrate allowing the claim of the Respondent, who was the Plaintiff in the court below. For completeness, the Plaintiff’s claim against the Second Defendant was dismissed by the learned Magistrate. By the impugned decision, the learned Magistrate ordered the First Defendant to pay the Plaintiff: (a) a sum of RM60,000.00; (b) interest thereon at the rate of 5% per annum from the date of filing of the Writ; and (c) costs on a scaled basis. The Plaintiff’s claim against the Defendants in the Magistrates’ Court was premised on a payment made by the Plaintiff to a third party. The central issue in this appeal is whether the learned Magistrate erred in fact and/or in law in making the aforesaid orders against the First Defendant, thereby warranting appellate intervention by this Court.
