Setelah mendengar hujahan pihak-pihak, saya dapati isu yang perlu dipertengahkan di sini adalah sama ada Pengadu telah gagal memaklumkan kepada Defendan berkenaan cuti sakitnya dalam masa 48 jam. Hal ini adalah kerana keputusan utama JTK dalam menolak tuntutan pengadu bukan atas alasan kegagalan Pengadu memaklumkan cuti sakit yang pertama (6.4.2020 - 4.5.2020) tetapi atas kegagalan Pengadu yang telah gagal, enggan dan cuai untuk memaklumkan cuti sakit tambahan (4.5.2020 – 11.5.2020) kepada Defendan dalam tempoh masa 48 jam dari tarikh beliau menerima cuti sakit tersebut. Merujuk kepada Seksyen 60(F)(2) Akta Kerja 1955, undang-undang telah memperuntukkan:- (2) An employee who absents himself on sick leave- (a) which is not certified by a registered medical practitioner or a medical officer as provided under subsection (1) or a dental surgeon as provided under subsection (1A); or (b) which is certified by such registered medical practitioner or medical officer or a dental surgeon, but without informing or attempting to inform his employer of such sick leave within forty-eight hours of the commencement thereof; shall be deemed to absent himself from work without the permission of his employer and without reasonable excuse for the days on which he is so absent from work.
