Full trial – claim by individual Plaintiffs against the same Defendant for breach of contract and quantum meruit. Consolidated Suits. The Defendant counterclaims against individual Plaintiffs for loss incurred. Issue: Whether the Defendant is liable to pay the Plaintiff the balance outstanding sum after taking into account the advance payment made by the Defendant together with the late payment interest of 1.5% per month accruing thereon from the dates of the respective invoices issued? The Court finds that the Plaintiffs are entitled to claim from the Defendant for services rendered and for all works carried out and completed at the site on a quantum meruit basis but on a pro-rated basis for the actual work done on the site.
