1. This is an interlocutory matter arising in a writ action commenced by the Plaintiffs against the Defendant for liquidated ascertained damages. 2. There are three applications before this Court for determination, namely Enclosures 9, 11 and 32. 3. Enclosure 9 is an application by the Defendant seeking an extension of time to file and serve its Defence. Enclosure 32 is a subsequent application by the Defendant to amend Enclosure 9 by adding the following underlined words to prayer 2 in Enclosure 9, that is: “Bahawa lanjutan masa diberikan kepada pihak Defendan untuk memfailkan dan menyerahkan Pernyataan Pembelaan ke atas pihak Plaintif di dalam tindakan ini.” 4. Enclosure 11, on the other hand, is the Plaintiffs’ application for judgment in default of defence against the Defendant.
