1. The ramifications of the present striking out application, premised on the Plaintiff’s alleged non-compliance with an Unless Order, cannot be overstated. If allowed, the Plaintiff’s entire Originating Summons would be disposed of without being tested on its merits. 2. In the premises, this Court must approach the application with the utmost care and circumspection, bearing in mind the seriousness of the consequences involved. It is therefore incumbent upon this Court to consider, with particular care, the parties’ respective contentions and the authorities relied upon. 6. Two principal issues arise for determination. 7. The first is whether the Plaintiff has failed to comply with the order made by the learned Judge of the High Court on 15 October 2025. 8. The second, which arises only if the first issue is answered in the affirmative, is whether such non-compliance warrants the striking out of the Plaintiff’s Amended Originating Summons and Affidavit in Support pursuant to the terms of the said order.
