Interlocutory application – application filed by the Respondent to set aside the prohibitory order and for a stay of execution. Issue: Whether there is a need to serve cause papers on the Respondent? Whether there is a failure to fully disclose the decision of the appeal that is being challenged at the Court of Appeal? Whether a stay of execution would be in the best interest of justice? The Court finds that the prohibitory order was regularly obtained having fulfilled the requirements under Order 47 rule 6 of the Rules of Court 2012 There was no need to serve cause papers on the Respondent. The Court also finds that the Respondent has failed to show special circumstances for a stay of execution. Court hereby dismisses the application to set aside the prohibitory order as well as the stay of execution.
