[1] This is an appeal against the decision of the learned Sessions Court Judge (SCJ) that allows the Respondents’ claim against the Appellant (Appeal). The Respondents also cross appeal to alter the accrual date of the interests (Cross Appeal). [2] For ease of reference, the respective parties will be referred to as the Plaintiffs and Defendant as they were in the Sessions Court. [3] As this Court has decided that the appeal is allowed, consequently, the cross appeal is also dismissed accordingly. [4] The Appeal is allowed and the cross appeal is dismissed with costs.
