Appeal against Session Court decision made on pleadings without trial dismissing the Plaintiffs claim. Previous decision which dismissed O.14A application and directing trial. Issues – Whether Plaintiff had locus standi to commence suit; whether there had been wrongful or unlawful usage of the maintenance fees by MC to pay for legal fees incurred by individual committee members. Court : Having decided previously that the 0.14A application be dismissed and the matter proceed to trial, and in view that there were triable issues, this Court finds that a full trial should have been conducted. Appeal allowed and matter remitted to the Session Court for a full trial to be conducted by a different Session Court Judge.
