discovery of documents against Bursa Malaysia Depository Sdn Bhd-and Bursa Malaysia Bhd-Order 24 Rule 7A (2)-Rules of the Court 2012-Order 24 Rule 7A (2) ROC 2012-The right of a party to production of a document under Order 24 ROC 2012 is subject to Order 24 rules 8 and 13 ROC 2012.-Order 24 rules 8 and 13 ROC 2012 state that an order for the discovery or production of any documents for inspection shall not be made unless the Court is of the opinion that the order is necessary either for disposing fairly of the cause or matter or for saving costs.-The test is not whether the discovery or production of the documents would fairly dispose of the case, save time of trial and cost of calling witnesses. The emphasis is on necessity not fairness and it is for the applicant to satisfy the court. The burden is on the applicant and he must provide materials to satisfy the court of such necessity-fishing expedition-Discovery application is not for information-All parties affected by a court order must be made parties to the application-Section 43 of the Securities Industry (Central Depositories) Act 1991-Section 43 of the Securities Industry (Central Depositories) Act 1991 makes it clear that Bursa Malaysia is strictly prohibited from giving, divulging, revealing or otherwise disclosing any information or document whatsoever relating to the affairs of any depositors and in particular relating to their securities accounts, i.e. the CDS accounts to any person-The prohibition in Section 43 of the Securities Industry (Central Depositories) Act 1991 is subject to permitted disclosures under Section 45-court will enforce a statutory prohibition placed on a bank not to disclose information to a third party-
