1. In this suit, the plaintiff suffered injuries following an elective abdominal surgery performed by Dr Yogaraj (D1) on 10.07.2018 at KPJ Sentosa Medical Centre (D2). The plaintiff is suing D1 and D2 for: (i) Breach of duty to provide informed consent. (ii) Breach of duty to diagnose and treat appropriately. (iii) Direct and vicarious liability of D2 for organizational failures and lack of credentialing of D1. 2. After a full trial, I allowed the plaintiff’s claim against D1 (award damages of RM917,710.00) and against D2 (award damages of RM50,000.00) respectively, and costs.
