By way of Enclosure 405, the plaintiff is seeking leave to amend its Amended Writ, the Statement of Claim, the Reply to the First Defendant's Defence, the Reply to the Fourth and Fifth Defendants' Defence and the Reply to the Sixth Defendant's Defence, as well as any consequential amendments to these defences by the first, fourth, fifth, and sixth defendants ("defendants"). Enclosure 405 is being objected to by the defendants. After reviewing the specific details in the proposed amendments, the Court finds that it is necessary for the plaintiffs to provide additional details on top of their existing pleadings. This will enable this Court to determine the real issues and disputes between the parties by ensuring that all issues and facts are complete before this Court. To this end, it appears to the Court that new and complete facts were discovered through the process of exchanging documents, which makes them necessary. Taking all of this into account, the Court finds the plaintiff's amendment application to be meritorious and, as such, Enclosure 405 is allowed with costs in the cause.
