Full trial – - Medical negligence - liability conceded – issue of appropriate quantum of damages. Issues : Whether the Plaintiff was justified in seeking treatment in Singapore GH and whether the amount claimed was reasonable. Court : 1) Based on facts and expert evidence, the Court finds that Plaintiff was justified in seeking treatment in Singapore. However, although the Plaintiff expended SGD148,752.46, the Court awards RM 200,000.00 based on the evidence at trial that similar treatment at a private hospital in Malaysia would have cost RM150,000.00 – RM200,000.00. 2) Plaintiff also awarded General Damages of RM150,000.00 for pain and suffering and costs of RM 40,000.00
