Court finds : 1. D did indeed at as common solicitor and owed a duty of care; 2. the non calling of an expert witness was not fatal in that the Court could ascertain for itself on the facts and evidence; 3. P has failed to establish that D was negligent or had breached any fiduciary duty; and 4. P failed to prove loss and damage. Plaintiffs claim dismissed.
