As set forth in Enclosure 164, the plaintiff seeks directions concerning the taking of accounts and inquiries under Order 43 rule 3 of the Rules of Court 2012 ("ROC 2012"). The Court finds that upon reviewing the Judgment, the process of taking accounts and inquiries for the purpose of assessing damages should not stray beyond the scope of the original Judgment that it had pronounced earlier, which should reflect a correct understanding of the nature and effect of the Judgment. It is therefore outside the scope of the Judgment for the plaintiff to now deliberately seek to broaden the scope of the 'account' to be provided by the defendant by not following the terms of the original Judgment. In light of the above, the Court is constrained to dismiss Enclosure 164 with costs of RM10,000.00, subject to allocatur.
