The Plaintiff, a beneficiary of her late father's estate, sued the Defendant Administrator for an injunction compelling distribution of the remaining estate assets. The Defendant applied to strike out the claim under Order 18 Rule 19(1)(a), (b) and (d) of the Rules of Court 2012. The High Court allowed the application, finding that the Plaintiff had, in fact, received distributions exceeding her Faraid entitlement and had concealed material facts from the Court. The suit — filed mere weeks after the Plaintiff discontinued an earlier action on the same subject matter — was held to be frivolous, vexatious, and an abuse of process, as it circumvented a prior court order barring the refiling of certain relief. The claim was plainly and obviously unsustainable and was struck out in its entirety with costs.
