Upon reading the Defendant’s Notice of Application dated 15 January 2026 (Enclosure 7), the affidavits filed herein, the written and oral submissions of learned counsel for the parties, and upon due consideration of the applicable law, it is hereby ordered and directed that: 1. Enclosure 7 is allowed. 2. The Plaintiff’s Amended Writ of Summons and Statement of Claim dated 2 December 2025 are struck out in their entirety. 3. The Plaintiff’s action is dismissed with finality. 4. Costs of RM5,000.00 are awarded to the Defendant subject to 4% allocatur.
