By way of Enclosure 36, the first defendant seeks to set aside the Order made in the Originating Summons, which was obtained by the plaintiff in the first defendant's absence. According to the first defendant, since he was not given the opportunity to defend the plaintiff's action, the court order must be set aside. Having considered the parties' arguments, the court finds that the cause papers were regularly served on the first defendant in Taiwan. The court also finds that the decision to grant the Originating Summons was not solely based on the non-appearance of the first defendant on the date of the hearing of the Originating Summons, but rather on the merits of the plaintiff's argument. Therefore, the court cannot rehear the merits of the Originating Summons based on the same. In view of this, the court dismisses Enclosure 36 with costs of RM4,000.00, subject to allocatur.
