The following constitute my rationale in deciding this matter whereby upon hearing the appeal against the decision of the trial magistrates’ court that convicted and sentenced the accused person, I allowed the appeal and set aside the conviction and sentence passed under section 41(1) of the Road Transport Act 1987. Aggrieved with my decision, the prosecution lodged a notice of appeal dated 27/06/2023 to the Court of Appeal. Premised on the rationale, it is my judgment that this is a proper and fit case for curial intervention as there are meritorious appealable errors committed by the trial court and as a consequence of that, the appellant must be acquitted and discharged accordingly. Decision of the trial court dated 24/4/2022 is hereby set aside in totality and so ordered.
