Forfeiture of property under AMLATFPUAA. This case concerns the forfeiture of shares under the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001 (AMLATFPUAA). The Public Prosecutor sought to forfeit shares allegedly acquired through unlawful proceeds arising from alleged manipulative practices under the Capital Markets and Services Act 2007 (CMSA). The court ruled that section 179 of the CMSA was not a “serious offence” under AMLATFPUAA at the relevant time and that the prosecution failed to establish fraudulent intent or trace the funds conclusively. The application was dismissed.
