The following constitute my grounds of judgment for an appeal arisen against my decision handed down on the 30th of November 2023 pertaining to sentence passed for plea of guilty under sections 12(2) and 6 of the Dangerous Drugs Act 1952 and section 30(3) of the Poisons Act 1952. The facts are straightforward and of no complexity. 1st accused person pleaded guilty unequivocally without any reservation. After carefully considering, I ordered the following sentence to be served by the 1st accused person: a) 1st alternative charge under section 6 of the Dangerous Drugs Act 1952 – 10 years of imprisonment from the date of arrest (20/9/2021) and 10 strokes of whipping; b) 2nd charge under section 12(2) of the Dangerous Drugs Act 1952 – two years of imprisonment from the date of arrest (20/9/2021) and 3 strokes of whipping; and c) 3rd charge under section 30(3) of the Poisons Act 1952 – one year of imprisonment from the date of arrest (20/9/2021). All the imprisonment term to be served concurrently.
